Terms of Service

Effective: September 5, 2026

1. General provisions

These Terms of Service (the “Terms”) govern the use of the holedzhetek.hu website (the “Website”). The Website is operated by OBEV Kft. (registered seat: 4551 Nyíregyháza, Vackor utca 7., Hungary, company registration number: 15-09-089257, tax number: 27484571-2-15 - see the Legal Notice page for details) (the “Service Provider”).

By using the Website, the user (the “User”) accepts these Terms.

2. Description of the service

The Website is an online gym directory and comparison service that makes publicly available data about gyms, fitness studios, CrossFit boxes, yoga studios and other sports facilities operating in Budapest searchable and comparable. The Website is not a booking or scheduling system - actual contact with a gym, purchasing a membership, or booking a session is a transaction between the User and the given gym, independent of the Service Provider.

3. Registration and user accounts

The Website can be browsed without registration. Registration will be required in two cases:

• Visitor account (optional) - to save favorites and comparisons.
• Gym owner account - as part of the “Claim this listing” process, to verify a gym's profile and to access the Featured/Pro packages.

Information provided during registration must be accurate. The User is responsible for keeping their account password confidential.

4. Source and accuracy of gym data

The gym data shown on the Website (opening hours, contact details, prices, amenities) comes from multiple sources, including automated third-party data sources (e.g. Google Maps, OpenStreetMap), and may not always be up to date or accurate. The Service Provider strives for accuracy and regular updates but does not guarantee the complete correctness of this data. Users are advised to verify decisive information (e.g. current opening hours, prices) directly with the given gym.

Through the “Claim this listing” process, gyms will be able to verify and correct their own profile - data from a verified (claimed) profile will take precedence over data from automated sources.

5. The “Claim this listing” (profile verification) process

A gym's representative will be able to claim the gym's profile after registering and proving their authorization to represent the gym (e.g. via a company email address, a phone call, or another method accepted by the Service Provider). Once verified, the profile becomes editable by the owner and gains access to the paid packages.

The Service Provider reserves the right to reject a verification request if the proof provided is inadequate or shows signs of abuse.

6. Subscription packages and fees

Exact prices will be published on the Website's pricing page, and the Service Provider is entitled to change them with prior notice. Prices are in Hungarian forints (HUF), net of VAT.

Payment: payment will be processed through Stripe, integrated into the Website. The Service Provider does not have access to card data.

Invoicing: the Service Provider will issue an electronic invoice for every subscription payment in compliance with applicable law, automatically, through Billingo.

7. Cancellation

A subscription will be cancellable at any time from the User's dashboard; cancellation takes effect at the end of the current billing period - fees already paid for the current period are not refunded, unless otherwise required by law (e.g. consumer withdrawal rights).

8. Intellectual property

The Website's design, source code and the original content created by the Service Provider (e.g. blog posts) are protected by copyright. Regarding photos and descriptions uploaded by gyms, the uploading gym warrants that it is entitled to have them displayed on the Website.

9. Database protection - prohibition on bulk data extraction

Compiling the gym database on the Website (collection, verification, organization, ongoing updates) required a substantial investment by the Service Provider, and is therefore protected under the sui generis database right (based on EU Directive 96/9/EC, as implemented in Hungarian copyright law, Act LXXVI of 1999).

It is prohibited to extract, download, reuse in bulk, or use to build a competing database or service, the data found on the Website, by automated means (scraping, crawling, bots, or other automated querying), without the Service Provider's prior written consent. This prohibition does not apply to ordinary, human browsing, nor to the lawful indexing activity of search engines (e.g. Googlebot).

In case of a breach of this prohibition, the Service Provider is entitled to restrict or block the access concerned, and to pursue legal action (claims for damages, proceedings to stop the infringement).

10. Limitation of liability

The Service Provider strives to ensure the continuous, error-free operation of the Website, but assumes no liability for temporary unavailability of the Website, nor for damages arising from inaccuracies in data taken from gyms or third-party data sources (see point 4). The Service Provider is not liable for legal relationships between a gym and a User that arise outside the Website (e.g. a membership contract).

11. Dispute resolution, governing law

These Terms are governed by Hungarian law. The parties shall primarily seek to resolve any disputes amicably. Failing that, the matter shall be brought before the Hungarian courts, or, in the case of a consumer dispute, the competent conciliation board.

12. Changes to these Terms

The Service Provider is entitled to unilaterally amend these Terms; notice of any changes will be given on the Website with reasonable advance notice before they take effect.

13. Entry into force

These Terms are effective as of the date indicated above and apply to every User of the Website.

Points 3, 5, 6 and 7 relate to planned features of the Website that are not yet live (registration, “Claim this listing”, paid subscriptions) - these Terms will be updated to reflect actual operation once they launch.
